That's still murder (or manslaughter) and he would be convicted easily. Consensual rough sex shouldn't leave marks or lasting damage of any kind, if it does, you are doing it wrong, holy f***balls. It's about control, dominance and the illusion of danger, but it should always be 100% safe. This is the reason that every single person you know who is into BDSM (and it's more than you think...) isn't walking around with bruises on their face constantly. If she does, in fact, have a skull fracture the fact that she requested rough sex doesn't matter, that's assault. Everyone has different pain thresholds and preferences. Also some people legitimately get off on being hurt.

I read another AP article and it’s general consensus LA is under no obligation to let him take the field. Union can only file a grievance saying that’s a form of punishment and really the team would come back with something like it’s a safety issue. In the meantime, he’s sitting. In any event, most (media wise) seem to think letting him take the field is more damaging to whatever little consequences a grievance could bring. If he takes the field, I’ll go ahead and assume LA feels confident in their internal investigation up to this point. They don’t have all the facts but more than us for sure

Surprising, and maybe also telling of the status of the investigation, that they haven’t acted yet despite the huge amount of pressure.

Cases like this have been tried numerous times at our Supreme Court. They are interesting reads. I believe in autonomy and freedom. If someone wants to be slapped around and choked out in bed, I don't think the other person should be held to the legal fire for the reasonably foreseeable results. If someone wants their sexual partner to cut their arm off, then a line has been crossed and public policy should say that the person doing the cutting should be held to the legal fire i.e. tried for serious assault. There is a line in the sand. Somewhere.

Bauer isn't denying that rough sex occurred and the photos are consistent with that. But it's a matter of if it was consensual or not and the texts exchanged between the two seem to corroborate his account of events. He is an absolute dumbass for falling for this in the #MeToo era though. He'll likely avoid criminal charges (though an ambitious DA looking to make a name for themselves could change that) but he'll be dealing with some serious fallout from this. He's going to be hung in the court of public opinion which will force MLB to do something punitive. He needs support from the Dodgers org but I don't know if they'll have the stomach for it. Worst case scenario they could try to void his deal and he might have a hard time signing on with another team.
