TMZ hasn't got any news yet. This is too tight-lipped for my liking. It's obviously really bad...or it's nothing and not news.

 

Seriously though I've had a friend tell me that he heard it was a guy. Another friend who is friends with Goins and Alford told me that it's super serious and the girl who isn't one of his baby mamas is in the hospital. Then someone who works for the Jays says they heard it's nothing to be concerned with. I'm at home after a car accident, so I'll keep digging for you all, until I break the story for loads of money (what's an Osuna story pay...like $15?)

In domestic assault charges it is routine for investigators to do a K.G.B statement (video recorded under oath) with the complainant in the early stages. If the complainant has a change of heart the Crown can proceed without his/her consent with that video in their back pocket. If at trial they become an adverse witness the video is played and the Judge can accept the earlier "testimony" as evidence.

Even before this occurs, the complainant can be threatened with criminal charges including public mischief, perjury, and obstruction of justice to compel cooperation (actually laying the charges is something altogether different). Witnesses that fail to appear after a summons has issued can be the subject of a warrant (usually endorsed) and a refusal to answer questions can result in contempt of court charges.

 

In short, reluctant complainants are not a bar to conviction. I would add that the days of just dropping charges or issuing peace bonds are nearing extinction.

 

I'll preface this by saying that I know there are quite large regional differences in police behaviour between the provinces (heck, even within provinces), but this is what I would say:

 

1. It is not common for police to do a video taped statement for a simple assault

2. It is common to release the accused on his own recognizance with standard conditions + no contact order + non attendance at complainants home, work, etc.

3. It is common for a simple domestic assault to be handled through mediation (especially for a first time offender)

4. It is not common for police or the Crown to "threaten" a recanting witness and even less common for them to follow through with it, although they will obviously tell them what the law is

 

Like I said, I know there are large regional differences in police practices, and I'm not working in Ontario, but I find my experiences to be pretty different from yours.

You're absolutely correct, especially on point #4.

Not good. None of those details provided in that article imply anything other than a prolonged and intentional attack. Significant injuries and the building concierge was the one who called it in, not some neighbour who might have overreacted to hearing a shouting match or something.

If he isnt charged with assault causing the injuries cant be that severe. Lets not forget what Chapman did and hes still pitching.

I don't like to jump to conclusions... but he sounds cooked.

 

It's fun though. Everywhere else I look they have disabled comments. We are the new standard for reporting in the Jays world.

If there's a void for baseless speculation about domestic assault by Jays players, this forum should be actively trying to fill that niche and grow our base. We should replace the Halladay picture with Osuna looking sad in his jail cell.

Visible injury would mean assault. Maybe didn't put her in the hospital, but enough to make him a huge piece of s*** and probably get charged.

Of course we're just speculating, but this isn't sounding like he's innocent. Sounding worse with each passing hour.

It's fair to assume that significant injuries means this is more than cop talk. I hate how anyone who speculates on the severity of these injuries is all of a sudden a SJW, or ridiculed for apparently taking the woman's side. It seems more than likely that Osuna has done something awful, and if he has I hope they make him pay the price.

 

Obviously I'm not going to crucify him unless we have more information but domestic violence is a no fly zone for me and it should be for literally every single male on the planet as well.

He sounds boned to me. My guess is he gets suspended for the rest of the season. After that I have no clue...Jays could keep him and try to rehab his image rather than trading him. Also a chance they trade him to someone else and he's pitching 2019 in a different uniform.

At this point even if it turns out it was something like an argument that got of of hand on both sides, and no criminal charges stick, all it takes is a leaked photo of the woman's "significant" injuries (e.g. with a black eye) and his Toronto career is done.

 

If it's worse than that and he's beaten her up then we might not even be able to trade him.

Matt Bush also stole a teammates car, drove drunk and ran over the skull of an old man....twice. That isn't discussed enough IMO. We should all s*** on Matt Bush every time he pitches.

Maybe not. But I'm betting Dean thinks his source is pretty reliable. Pretty sure you don't want to get called out on saying a dude punched his girl and threw her down the stairs if it didn't happen. That's lawsuit stuff right there.

Also it would come shockingly close to the Danry Vasquez stairwell incident.

Maybe Thanos can use the time gem and take us back a few weeks so we can trade him and maybe this incident doesn't happen.
