I just re-read the rule, a tie would go to the runner as the rule states and the runner or 1b must be tagged by the fielder before the runner hits first base. So, if they both there at the same time, the runner cannot be out.

It sort of makes sense, because assuming both the runner and the ball arrive at the same it's almost like the runner beat the ball. It's 50/50 so I guess according to replay rules a call that close would always stand with the ump's original one.
