G-Snarls Community Moderator Posted May 14, 2018 Posted May 14, 2018 Yeah likely. One of the Oakland A's players can't enter Canada either right now because of a legal issue and will miss their series here. He pulled a gun on a food delivery worker and gets sentenced June 4th. MLB is becoming the NFL Jeez (kidding)
P2F Old-Timey Member Posted May 14, 2018 Posted May 14, 2018 That was genuine crazy man Bruce Maxwell. Old news from the winter.
Jimcanuck Old-Timey Member Posted May 15, 2018 Posted May 15, 2018 that raises the question of Osuna's ability to enter Canada or the US.... depending on the outcome a conviction possibly means deportation to Mexico and an inability to enter Canada (or the US) in the future
Krylian Old-Timey Member Posted May 15, 2018 Posted May 15, 2018 That was genuine crazy man Bruce Maxwell. Old news from the winter. Was that the story where he claimed racism or some s*** like that and apparently that never happened?
P2F Old-Timey Member Posted May 15, 2018 Posted May 15, 2018 Was that the story where he claimed racism or some s*** like that and apparently that never happened? Nope. Believe it or not, this was an entirely different incident. IIRC, it happened only a couple of weeks after...whatever that was. He had a productive offseason. Something, something, best shape of his life.

BTS Community Moderator Posted May 17, 2018 Posted May 17, 2018 Blue Jays' Osuna ordered to stay away from downtown Toronto building https://www.thescore.com/mlb/news/1546016 Toronto Blue Jays relief pitcher Roberto Osuna has been ordered to remain at least 100 meters away from a building near Lake Shore Blvd. W. and Strachan Ave. in downtown Toronto, according to court documents acquired by Vjosa Isai and Wendy Gillis of the Toronto Star. Additionally, Osuna is not permitted to communicate with the woman he's been charged with assaulting after his arrest on May 8. A condition of his release states he cannot possess weapons or consume alcohol. Osuna is scheduled to appear in a court designated for domestic offences on June 18. The 23-year-old was placed on administrative leave by MLB following his arrest. This leave has been extended through May 21 amid the investigation and there is no timetable for his return to the Blue Jays.

BTS Community Moderator Posted May 17, 2018 Posted May 17, 2018 - not permitted to drink or possess weapons - banned from a building, presumably where the alleged victim lives - prohibited from contacting the alleged victim It sure doesn't sound like this is going away.

I think ontario pushes for weapons bans against anyone charged with assault.
Grant77 Old-Timey Member Posted May 17, 2018 Posted May 17, 2018 A lawyer friend says that weapon and alcohol bans are standard in assault cases that don't involve Canadian citizens. It certainly doesn't mean that he was sober and had no weapons, but we really can't glean anything from that information.

If he way from, say Norway, this wouldn't even be happening.

Police often hand out conditions that seem logical on the surface, but they're just following a local formula and apply them without thinking. It can be very frustrating, especially when you realize that cities across Canada vary widely on what conditions they impose. Take a look at this table for example (I do note this is for those charged under the Young Offenders Act, however I think the point still stands): http://www.justice.gc.ca/eng/rp-pr/cj-jp/yj-jj/rr04_yj1-rr04_jj1/t2_2.html Are we to believe that youth in Winnipeg are much more dangerous at night than youth in Toronto? I do grant that different areas may have unique issues, but this variation can't make sense. My area is not listed in that table but they hand out no alcohol and curfew conditions like candy, even for dry events that happened during the daytime.

I’m more interested in knowing if these conditions (especially not contacting the alleged victim) are often given if the victim isn’t ooperating with police.

Not contacting the victim is a pretty standard restriction in any assault case The 100m thing is a combination of requests from the victim and whether police believe another assault could occur. He again stressed that this could be different with non-citizens, so it's really just speculation at this point.

So it does seem unlikely at this point that this is a situation where the victim wants to drop the charges and the police want to pursue them.

I don't think we can conclude anything about what happened or is happening based on the conditions imposed.
