  1. "Following the questioning, both Franco and the mother of the minor who made the allegation were detained and they are expected to be held for 48 hours." The mother, too?
  2. Hard to see him ever getting a US visa, regardless of what MLB does.
  3. Not devastated. Have had plenty of time to process. Hope he has good lawyers.
  4. This is just a clever tactic by connor to win some votes for the end of year awards.
  5. It deserves its own thread really. "Gibby's Xmas Message" or something
  6. Vid is in the wrong thread. A certain crowd will not visit this thread.
  7. Translation: Wander Franco will appear before the Public Ministry in Puerto Plata next Tuesday, January 2. @Olgadinall in the morning hours.
  8. No lesson, you are dumn
  9. The suspension was after a 9 month investigation. Same reason Franco has not been suspended yet, the investigation is ongoing.
  10. I didn't omit anything and there is no need anyway. The independent arbitrator panel determined that Bauer did, in fact, contravene MLB's policy. MLB did its due diligence, carrying out a 9 month investigation, BEFORE Bauer was suspended. Prior to the suspension, he was on the restricted list and continued to be paid. You do not have the information the arbitrator panel used to make its decision, information that will be confidential as this is an HR issue. What you think, based on the social media you choose to rely on, is of zero import.
  11. Good luck, Carlos.
  12. Bauer would have a high bar to overturn the arbitration panel's decision. https://www.lexology.com/library/detail.aspx?g=c656521d-2f05-4333-8eb1-1d938d66d051 Judicial review of disciplinary matters is rare, though not impossible. The parties to arbitration may appeal the decision to federal court under the Labor Management Relations Act (LMRA)25 and Federal Arbitration Act (FAA).26 The courts' review of the arbitration award is deferential, as courts have little authority to overturn an arbitration on the merits and are generally limited to fundamental procedural flaws, such as fraud or misconduct or arbitrator bias. NFL quarterback Tom Brady of the New England Patriots lost under this standard when he appealed his suspension for his alleged deflating footballs, a scandal known as Deflategate, to federal court under the LMRA. Brady argued there were numerous problems with the arbitration, including lack of notice under the CBA, but the Second Circuit upheld the suspension because 'this case is not an exceptional one that warrants vacatur' given the deferential standard.
  13. Not conflating anything. You haven't demonstrated a single sentence I have written to be incorrect. Your bald statements are disregarded.
  14. So cancel culture is a business being responsive to its clients / fanbase?
  15. There's no defamation case against MLB. The policy that was contravened is in the CBA that Bauer signed onto through the union. The arbitration panel (3 person) determined Bauer contravened the policy. Good luck with the case, Carlos.
  16. True, but what does that have to do with the discussion?
  17. There is nothing there that comes close to slander. MLB never stated Bauer committed a crime. Bauer lost his defamation case against Deadspin.
  18. If the Padres eat 1/3 of the contract, and made the trade, nothing stopping the Jays from renegotiating the payment terms to be more front loaded or whatever to match their expected salary demands over the next while.
  19. Machado should very much be in play, with SS Jackson Merrill (BA #13) being MLB ready, and Kim a very competent 3B glove. Padres would need to eat a hefty amount of Machado's salary.
  20. So what are the MLB statements that rise to the level of slander?
  21. It's really just a few that suffer from arrested development.
  22. So we agree on what the principle of the claim would be, but not the timing of the claim filing or how damages would be calculated. Law 101 questions. We can stop now.
  23. MLB is just protecting its brand. I have no idea what "cancel culture" is. Is it when you do something offensive and there are consequences. Accountability?
  24. Bauer suffers no loss if MLB does not suspend him - he would still be playing but for the suspension. Any and all claimed damages would accrue from the suspension, including a claim of loss of future income.
