    No, principle of the claim is looked at firstly and separately from damages. You do not have to have fully substantiated damages to have a successful claim. The arbitrator option is closed. Litigation is the only remaining option for Bauer. Slander is a non-starter. MLB did not find him guilty and never said as much. They found he contravened the policy and the arbitrator panel agreed. There is zero evidence to support suing for slander. Bauer's only case is that the suspension was improper or excessive.

    Hoskins yes Steamer projects Duvall for 0.3 WAR. Biggio is projected for 0.9 WAR in fewer PA. Jays can easily do far better than Duvall.

    Where is Laika right and I am wrong? The only part unclear is date of discoverability. Usually, the date of discoverability is when the loss first begins to accrue or a loss becomes known, which would be April 2022. If the loss is going to continue through the proceeding and into the future, the accumulating losses are taken into account in a decision. Bauer's lawyers are unlikely to take a chance the courts will determine discoverability to be April 2022, and not some later date. If he is going to sue, the claim will be filed before April 2024.

    An arbitrator already rendered a judgement under the CBA. Did read in an article by a reputable org that he can still litigate. Fair point on discoverability, although he could have signed with a MLB team last year... Understand it is difficult to overturn a decision made according to a process agreed upon by the parties (i.e., the 3 person arbitration panel)

    The date the suspension without pay started was on or about April 17, 2022. Have assumed this would be the date of discoverability and that the general 2 year period applies.

    Dodgers success with prospects predates Friedman. They were the first team to establish a baseball academy in the DR, in 1987. Now all 30 teams have a training facility in the DR. As long as I have followed baseball, the Dodgers have always been ahead of the curve when it comes to prospects and player development.

    He was suspended without pay. Bauer could fight this as unjust and still can up to when the limitation period expires (I believe this is April 2024). If not team signs him before then, you may well see him sue MLB and the Dodgers.

    Depends on the terms, but generally, if performance is not possible and is the fault of the player, the player is in default and the contract may be terminated.
