  1. The original accuser, the woman in Ohio, and this latest accuser. There will be others that haven't come forward publicly, but may have given statements in confidence to the MLB investigators.   9. plenty of people don't get charged or found innocent in trial, and lose the civil suit. in no way, shape or form, is not being charged absolving from civil liability and action taken by employer if the police do not even open an investigation, or quickly close the investigation, that's one thing. the length of the investigation and the time for the DA to make a decision on charges leads one to believe there is plenty there next step for Bauer is his appeal, and also, the civil suit he will be facing if he isn't already. and it appears he will lose.
  10. The investigators would make their findings and recommendation based on a balance of probabilities. The fact the DA considered laying charges but in the end decided the burden of guilty beyond reasonable doubt, much higher bar, could not be met, is pretty damning.
  11. Is arbitration even available under the collective agreement for this? I doubt it. He would have to litigate which would probably take years anyway.
  12. I don't think Bauer even has a legal remedy available here. He would have to prove the decision was vindictive and biased. Good luck with that!
  13. The first. The percentage of women that have experienced sexual abuse / violence is very high, and those that haven't are well aware of the fact. That's over 50% of the populace and isn't a good percentage of males that think Bauer is a f'ing creep that should be banned from baseball.
  14. MLB would have used independent investigations, as is standard for these cases, and they would be applying precedent from all labour relations, not just MLB.
  15. A very large chunk of MLB's fans and prospective fans will applaud this decision. A relatively small minority will not, but they will generally be baseball diehards anyway.

  17. Manfred would have acted on the recommendations of the independent investigators. He's not going to torpedo MLB's defence of its position by making an "executive decision".
  18. I think the fans will adjust very quickly. In any event the more important thing is to make the game more fair to both teams, and particularly the players that have to suffer from crappy umpiring.
