  5. Not really. The CBA will have specific terms regarding contract terminations, and what A-Rod wanted to do wasn't in those terms. The bar is very high to imply terms to a Contract. What you are suggesting happens is very rare.

  14. You are wrong, the intent of the parties is what is written and signed off on. No idea what you mean by "spirit", that is meaningless.
  15. Understand that. But as long as the Contract agreed upon by player and team does not break any of the bargained rules, MLBPA can do nothing.
  16. So as written what you suggest is doable: Incentives in contracts allow players to earn additional money by achieving certain predetermined benchmarks. Major League Baseball's Basic Agreement prohibits incentives from being awarded based on statistical achievement. Thus, playing time is the near-universal means by which players receive incentives. Pitchers with incentive-laden contracts typically trigger the incentives based on number of innings pitched, number of games started, number of relief appearances, number of games finished, etc. Hitters will most commonly trigger incentives based on plate appearances. Some contracts also contain roster bonuses, which reward a player simply for staying on the active roster for a certain number of days. In the 2011 wave of collective bargaining agreement negotiations, milestone bonuses were prohibited by the league, meaning that players can no longer receive contractual bonuses for reaching plateaus such as their 3,000th hit, 500th home run, 200th win, etc. So would Ohtani take $30M guaranteed with playing time bonuses that can bump it to $60M over $50M guaranteed, say?

  18. I picked up Spencer Howard for free a few weeks ago to stash in the minors. He laid down a 7 innings, 11K, 1 hit, 1 BB gem in AAA last night. Only a matter of time before he gets called up. HMU if interested.
