MLB considers it a waste of time for these cases to go to hearing, the first arbitrators meeting is usually about trying to get a settlement and then the two sides can save face in the public's eyes and say "came up with a last minute deal". I really think the Jays end up amending their File to trial policy and look for a middle ground...unless they are confident they will win (which I'm not). The Nats, Pirates, Indians and Brewers were hard line file and trial teams, who now consider them selves File and Trial by case. I think the Jays, Rays, Braves and White Sox are the last full file and trial (or file to trial as I prefer) teams. The Jays just haven't been tested on it in so long.
